Terms and conditions
At Arm Candy we like to keep things simple. We don’t like technical jargon or big words for the sake of it. If there is anything in these terms and conditions that you don’t understand, please contact us at email@example.com and we’ll try to explain it so that you do.
1) About Arm Candy
1.1) Arm Candy is a skill based competition to win a designer handbag, and is managed and promoted by Gear Digital Ltd. Gear Digital has a registered office at 7c Blackfriars House, Parsonage, Manchester, M3 2JA. Our team can be contacted on 0161 818 7110 or at firstname.lastname@example.org from 8:30am to 5.30pm Monday to Thursday and 8:30am to 3pm Friday.
2) About the competition
2.1) The competition is open to all those that live in the UK and are aged 18 years and over, except for Arm Candy and Gear Digital employees, their family members or anyone that is connected with the running of the competition. You must also be located in the UK when you play to successfully complete your entry.
2.2) To enter the competition you will be asked to agree to these terms and conditions.
2.3) To start you will choose your favourite handbag from the fabulous selection on our website. When the competition closes, if you’re the winner, the handbag you chose will be all yours!
2.4) To enter you must take part in our skill based challenge. This is the fun bit. We might use other challenges, but usually you’ll be asked to guess the number of sweets in a candy jar. You can add one guess for every ticket that you buy.
2.5) If you win (and we hope that you do) with your prior consent your name, location and images of you and your selected handbag will be used by Arm Candy in marketing materials to promote the competition.
2.6) Each competition lasts for a week and opens Monday at 00:00:00 am and closes Sunday at 23:59:59 pm. Once the competition is closed we arrange the official count to find out how many sweets are in the jar - and who has won their dream handbag.
2.7) If you alone guessed the exact number, or one of your guesses was the closest, you will be contacted as the winner.
2.8) If more than one person guesses the exact number, or provide the same closest
guesses, tie-breaker challenges will take place until one player is the outright winner. If you’re involved in a tie-breaker challenge and don’t end up being the winner you will be given a “runners-up” prize. These prizes are confirmed when you are contacted to take part in the tie- break.
2.9) If you win or are invited to take part in a tie-breaker challenge, we will contact you as soon as possible using your registration details after the official sweet count is in, and the result has been published on our website and to our followers.
2.10) In the event of a tie-breaker, you will be contacted and given 24 hours to provide your tie- break entry. If we are unable to contact you, or do not receive your entry within this time, in fairness to other players you will automatically forfeit your tie-break entry and will not be eligible to win a handbag. If you contact us within 7 days, you will still qualify for your “runners- up” prize.
2.11) We love to personally hand-deliver our handbag prizes to make Arm Candy even more special. We must be able to deliver your handbag within 28 days from when we first contact you.
2.12) Now and again we might not be able to source the exact handbag you chose from our list. It may be out of stock or supplies might be low. If this happens, we’ll contact you as soon as possible to discuss an alternative. This may be the same handbag in a different colour, a similar handbag by the same designer or a different bag altogether for the same value.
2.13) It’s a scary thought, but if you win and we can’t contact you within 28 days of the competition closing you will have lost your prize. Please make sure you answer our calls and emails to avoid this. We will always consider mitigating circumstances, but in the interests of fairness, we may announce another winner if there’s a ‘closest’ runner up, or advertise your handbag as a prize in a separate competition. If you lose your prize, no alternatives or compensation will be provided.
2.14) We hope we don’t ever have to, but we do reserve the right to withhold prizes if we believe there is good cause to do so. It’s really important that we protect our brand and the integrity of the competition for all our loyal players and followers.
2.15) Unfortunately, if you fail to make your entry in time, not submitted online or just incomplete, we cannot make allowances for this.
2.16) If you enter this week your guesses are valid for this week only. They will not be considered for previous or future weeks.
2.17) You can play as many times as you like each week, and might increase your chances of winning depending on how you choose your guesses. If you play more than once for different handbags, and you win the competition, you will win the handbag that relates to your closest guess. If the same guesses have been made for multiple handbags, we will ask you to choose which handbag you prefer from those you played for.
2.18) We may change these terms and conditions if necessary to ensure Arm Candy can continue in the spirit it is intended. We also reserve the right to cancel the competition if it is compromised in any way.
2.19) The decisions of Arm Candy regarding all competition matters, whether the primary competition or a tie-breaker, is final and binding. Arm Candy will not enter into correspondence regarding these matters
2.20) In our Mother's Day special competition (running Monday 18th March 2019 at 00:00 until Sunday 24th March 2019 at 23:59) the winner from that week will win a second designer handbag (from a choice of 5) as a present for their mum on Mothers Day. The winner and their mum must be available for the delivery meet up so Arm Candy can hand over the winning bags to both the player, and their mum.
3) Payments and charges
3.1) The cost of playing is based on the number of tickets you buy.
3.2) Ticket prices are payable in UK pounds sterling (£) and are inclusive of VAT. 3.3) Payment is required for your tickets to be valid.
3.4) If you feel the need to question any payments made to Arm Candy, we feel it’s only right to point out that refunds are only provided in exceptional circumstances and at the sole discretion of Gear Digital Limited, following a full review of your use of the website and the information you were presented with and provided as part of your entry.
3.5) For card payments, payment amounts are reserved until the transaction is completed, at which point the full payment is taken. If for any reason the transaction does not complete the funds will be released in approximately 3 - 5 days.
4) Marketing messages
4.1) If you opt in to receive marketing, or join the Arm Candy Community, we may send you marketing messages based on your preferences.
5) Important information
5.1) If you win, we will ask you for a suitable location to personally deliver your handbag. This could be a local hotel, restaurant or public place. It doesn’t have to be your home address.
5.2) If you win, and you decide to engage your local press, or other media, to celebrate your good fortune, we ask that all materials are pre-approved by the Arm Candy team. Please send these requests through to email@example.com.
5.3) The content on our website is general information and is not intended to be used as advice.
5.4) We’ll always try to keep our website up-to-date, but we can’t promise or guarantee that it will be.
5.5) Whilst we love our Arm Candy community, we will not be held liable to you for any losses, damages, negligence, wrongful acts, infringement of your rights, or otherwise, even if they can be predicted in advance, when connected with:
5.5.1) your taking part in our competition;
5.5.2) problems with taking part in our competition;
5.5.3) your use of or reliance on our website content. In particular, we will not be liable for:
5.5.3) loss of profits, sales, business, or revenue;
5.5.4) business interruption;
5.5.5) loss of anticipated savings;
5.5.6) loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
5.6) This competition is operated under the laws of England and Wales and the exclusive jurisdiction of the courts of England and Wales.
5.7) Apple Inc. is no way linked or associated with the competition.
